What is SEF 44?

If you are an Ontario resident traveling in California, the most important piece of paper you own is likely sitting in your glove box or on your phone: your Ontario auto insurance policy. Specifically, a “hidden” feature called SEF 44 (often listed as OPCF 44R in Ontario).

While the names are technical, the concept is simple: it is your safety net when a California driver doesn’t have enough insurance to pay for your injuries.

The Problem: California’s “Minimum” Insurance

In Ontario, almost every driver has at least $1 million in liability insurance. In California, the law only requires drivers to carry $30,000.

If you are seriously injured by a California driver who only carries the minimum, $30,000 will barely cover a few hours in a U.S. emergency room. Without SEF 44, you would be left responsible for the remaining hundreds of thousands of dollars in medical bills and lost wages.

The Solution: How SEF 44 Works

SEF 44 allows you to “bring your Ontario coverage with you.” If you have $1 million or $2 million on your Ontario policy, your own insurance company can be forced to pay the difference between the California driver’s small policy and what you actually need to recover.

Example:

  • Your total damages: $500,000

  • California driver’s insurance: $30,000 (The limit)

  • The Gap: $470,000

  • The Result: Your SEF 44 coverage steps in to pay that $470,000 “gap.”

Who Does it Cover?

The “Family” in Family Protection Endorsement is literal. It doesn’t just protect the person driving the car; it typically covers:

  • You (the policyholder).

  • Your spouse.

  • Dependent children (even if they are away at university).

  • Other relatives living in your household.

It even protects these family members if they are passengers in someone else’s car or if they are hit as a pedestrian.

Why You Need Two Specialized Firms

Accessing SEF 44 funds is not automatic. It requires a coordinated effort between two separate legal experts:

  1. The Simon Law Group (California): As a separate and independent U.S. firm, they must first “exhaust” the California driver’s insurance policy through litigation in California. You cannot access your Ontario SEF 44 until the California policy is fully paid out.

  2. Cross Border Justice (Ontario): We are your local Ontario-licensed firm. We manage the high-stakes paperwork and negotiations with your Ontario insurance company to ensure they honor the SEF 44 agreement once the California case is resolved.

A Quick Tip for Ontario Residents

Before you cross the border, call your insurance broker and ask: “Do I have the OPCF 44R (Family Protection Endorsement) and is my limit at least $2 million?” It is one of the cheapest additions to a policy, but it is the single most valuable asset you can have after a California accident.
